LGPL waiver Source Code Requirement 

 Dear Sir,

We would like to buy a Perpetual License for development + DISPLAY LGPL waiver for commercial deployment.

We like to know when we do the deployment, is it required to open our OWN developed Source Code also?

Hi Victor,

There is a difference in GPL and LGPL license requirements. Using GPL products would require you to distribute your code also as open source, whereas LGPL does not. You can see more information on our FAQ page here and viewing the Licensing and Deployment sections. As the Visual WebGui SDK is LGPL, the open source requirements for your own code do not apply. Only parts of the Visual WebGui SDK have in the past been GPL, most notably the Silverlight SDK, which is currently not supported anyway in the most recent versions of Visual WebGui.

You should pay attention to the fact that if you distribute (not same as used by) any of your application to more than 5 end-user organizations, you will need an OEM / SaaS license, as you can see in the FAQ list.

We are thinking  to use VWG Pro to develop the application and  SHOWS the LGPL waiver all the times.

For  this situation, do we also need an OEM/SaaS License for more then 5 end-user organizations?

Hi Victor,

The Licensing and OEM sections of our FAQ really tell the whole story. See here.

In short, they say that if your are using Express Studio you will need to keep the LGPL waiver visible. If you want to get rid of it, you need to purchase a Professional studio and/or OEM/SaaS license.

If you run your applications for your own organization, or users of your own organization (no limit for number of users), Express Studio (if you are ok with the waiver) or Professional Studio license is sufficient. Under this license, you can have as many applications as you want, as long as they are run for your organization.

If you start to distribute your application in any way, either by selling your application to other organizations, or you offer your application as SaaS for other organizations, then you can have up to 5 such agreements under the Professional or Express license. This counter counts for individual named applications, so if you have two different applications, selling each one to 5 other organizations, you would be covered by this license. When you need the 6th, you would need OEM/SaaS license. The same counter would be used for application you create for another organization which then resells your application to others. Distributed to Max 5 organizations in total for each named application before you need OEM/SaaS.

So, it means that even though a named Commercial Software Product (sure sell >5 different organizations) developed by VWG Pro shows LGPL Waiver all the times, it also violate the VWG License agreement ?
 
In fact I am a .Net developer and love the VWG Pro very much when I find it recently in Internet. I introduce VWG to my Boss to use it in our software products. I write some small Demo to him and tell him I can develop the application faster than using Flex and VWG GUI is beautiful enough. My Boss very happy with my job. BUT after he looked into the license requirement, he just say just NOT use VWG as the License agreement will place the company in risk as it has too many unclear terms and requirement and it seems IT MUST use OEM/SaaS License for Software Product (sure sell>5 set). After I strongly discuss with him, he say If I want to use VWG very much, he can accept buy the perceptual License and displaying LGPL Waiver in the software products. But if it MUST use OEM/SaaS license, he tell me to give up.  
 
So, VWG, can you give me a hand to help me? 
 
Please directly tell me a named Commercial Software Product (sell >5 different organizations) developed by VWG Pro with showing LGPL Waiver all the times is acceptable So that I can use VWG to develop Software Product instead of using Flex.
